Compensation vs. negligent neurosurgeon botched spinal surgery Milwaukee lawsuit nets $2.5 million dollar settlement amount

What is the average settlement for medical malpractice?

The settlement amount for malpractice lawsuits varies by your case. Pain may not be able to be stopped, but financial compensation is deserved if you are injured by medical negligence. Warshafsky won a $2.5 million settlement from neurosurgeon Cully White for his botched spinal surgery.

Settlement won in a malpractice case against Milwaukee neurosurgeon

By all accounts, Todd was a typical American success story. Starting in 1991 as an estimator at a Milwaukee roofing company, Todd had risen to become president of the company in 2010. Unfortunately, the excruciating pain he suffered after surgery to correct a back injury forced him to resign.

Todd was 35 when he first met with Dr. Cully White, a Milwaukee-based neurosurgeon specializing in spinal surgery. Todd believed the surgery Dr. White recommended would relieve the recurring pain he had been experiencing in his back. In 2007, Todd had the surgery. Instead of relief, though, the pain in his back was worse than ever. So bad, in fact, he needed to have a small pump implanted under his skin to drip pain-relieving morphine into his system 24/7. Todd struggled to continue working at the roofing company for a few years, but ultimately had to resign. Unable to work, he was left to support himself and his wife with the disability insurance he was receiving.

Nerve damage, back pain, botched surgery in Milwaukee: sometimes the only relief possible is financial

After learning about a similar case Warshafsky Law pursued against Dr. Cully White, Todd met with our personal injury attorneys to find out if he could also sue for damages. We felt he had a strong case and agreed to file a malpractice lawsuit on behalf of Todd and his wife. Our Milwaukee medical malpractice attorneys and investigative team worked diligently to prepare a winning case. As always, we prepared Todd’s case with the full intention of taking it to court, where it would be heard by a judge and jury.

The case was about to go to trial in Waukesha County Circuit Court when it finally dawned on the insurance companies named in the suit they didn’t have a legal leg to stand on. A last-minute request was made to discuss a settlement. Fortunately for Todd and his wife, Warshafsky Law personal injury attorneys negotiate as aggressively as they litigate. Result: A $2.5 million settlement was reached between the insurance companies and our legal team—another Society Changing Judgment for Warshafsky Law and a huge relief for our financially burdened client Todd and his wife.

As for Dr. White, Warshafsky Law had already been instrumental in having the neurosurgeon stripped of his license to practice. Additionally, White was investigated for health care fraud and sentenced to six months in federal prison, six months of house arrest, and a fine of $60,000.

Every day, Americans undergo surgeries to correct all manner of maladies. In the vast majority of instances, surgeons and physicians work wonders. As in any field, though, there are those who through incompetence or negligence make matters even worse. For those who have to live the rest of their lives in pain and with the haunting regret of having trusted someone they were led to believe would help them, it really is about the money.

Warshafsky’s no-win-no-fee representation means no risk to you

Warshafsky Law has a “No Win, No Fee” policy, which means there is no cost to you if we do not win your case (a highly unlikely scenario). We also will take your case with no upfront retainer fee or monthly legal bills whatsoever. You owe us nothing until your case is settled or a financial award is made as the result of a trial. There is absolutely no risk in hiring your best bet, our Wisconsin personal injury law firm.

Of course, you will never know what is possible if you do not take the first step of meeting with us. Take advantage of our free initial consultation to learn more about how we work and what we can do to help put your life back in order.  If you have been injured through a physician’s malpractice or a hospital’s negligence, there is a good chance you will not only be unable to work in the same capacity you once did, but you will also face years of therapy or additional surgeries to correct, or at least relieve, the damage which has been done. Fortunately, the law provides a way for malpractice victims to be financially compensated for their injuries by suing for medical malpractice.

To ensure you receive the highest compensation, you will need experienced attorneys on your side. With our reputation for fighting hard for our clients both inside the courtroom and at the negotiating table—and a long history of record-setting wins to show for it—you can trust the personal injury attorneys of Warshafsky Law to secure the maximum compensation possible in your case.
