A personal injury lawsuit can be filed in a snowmobile accident for situations including:
Every winter, snowmobilers across the state of Wisconsin look forward to riding the trails. It’s a great way to get out and enjoy the beauty of the outdoors. By the end of the season, though, there are dozens of injuries and fatalities involving snowmobiles. The vast majority of these are the direct result of operator error, and most involve alcohol. The most common cause of injury and death? Hitting something after failing to negotiate a turn.
If you have been injured in a snowmobile accident, you can file a suit seeking compensation for your medical expenses, lost wages from your job while you were recuperating from the injury, pain and suffering you endured, and loss of quality of life as a result of permanent damage caused by the accident.
Additionally, you can file for compensation for property damage caused by the accident (for instance, if a snowmobile hit your car). In the case of injury caused by a manufacturing defect or improper maintenance by a facility that rents snowmobiles, you will need to file suit against the manufacturer or the shop that rented you the snowmobile.
After an accident, the insurance company for the at-fault party will typically make an offer of settlement, usually in the form of a check. They’ll tell you they just want to make sure you’re taken care of. While the money can look really good, especially when you’re dealing with medical bills and unable to work, don’t endorse the check!
The insurance company behind the settlement check does not have your best interests at heart, and the check likely falls far short of the compensation you should be receiving. At the very least, get the advice of an experienced personal injury attorney. Most will offer a free consultation to evaluate the merits of your case. (As Warshafsky Law does.) The settlement check may be reasonable, but most of the time it isn’t.
In many cases, an experienced accident investigator can uncover hidden sources of liability beyond the obvious. When there is more than one liable party, the opportunity to increase the settlement or judgment rises significantly. Of course, you’ll never find this out unless you have a law firm like Warshafsky with an accident investigator on staff.
Warshafsky Law has a long history of winning huge settlements and judgments in personal injury lawsuits. Unlike other firms that are quick to settle with insurance companies, our personal injury attorneys prepare every case as though it will go to trial, so we win big for our clients. In cases involving fatalities, our wrongful death attorneys will compel those responsible to make restitution. In addition to representing clients in our home state of Wisconsin, Warshafsky takes on cases in other states throughout the US. If you are outside of Wisconsin, get in touch with us to learn more.
