Frequently Asked Questions

We have compiled a list of answers to some of the most common questions we receive as personal injury attorneys.

Most personal injury attorneys deduct their fees from any final settlement or trial award. The benefit of this type of contingency fee arrangement is that the client does not have to pay an upfront fee and won’t have to pay the lawyer’s fees unless they win their case. The typical attorney fee percentage is between 33 percent and 40 percent. So if your case settlement is $100,000, the attorney would take between $33,333 and $40,000 while you receive the remainder after all expenses and outstanding liens in your case are paid.

The statute of limitations in Wisconsin allows three years from the date of the injury for the injured person to file suit against the party that caused their injuries. You may be able to extend the deadline in some cases, but most of the time, if you file a lawsuit after three years have passed, the courts will dismiss your case without a hearing. Even though you technically have three years, you should initiate your claim as soon as possible while evidence is still fresh.

Depending on the scope of your injuries, you may be able to recover compensation for your:

  • Medical bills and continuing medical expenses
  • Lost income
  • Reductions in future earning capacity
  • Out-of-pocket expenses related to treating your injury
  • Pain and suffering
  • Quality of life reductions
  • Loss of consortium
  • Property damage

A personal injury attorney can take a full accounting of your tangible and intangible losses to ensure that they demand adequate compensation for you when filing your claim.
